K & K Swim School Policies

 1. Lessons will follow and be assessed in accordance with the K&K Swim School Curriculum, as amended by the Swim School from time to time.

2. Where the Client is provided with the personal contact information of Swim School instructors, it will be used for cancellations, scheduling, and Swim School affairs. The Client agrees to keep this information confidential and use it only for the matters outlined in this paragraph.

3. The Client acknowledges that he or she and the Client’s child will abide by all safety and pool regulations, whether posted or un-posted, as well as all rules and regulations pertaining to lessons that may be put in place by the Swim School from time to time.

4. The Client agrees to abide by the following rules and accept the following terms and conditions concerning lessons hosted in the pools of the Swim School’s hotel partners:

  1. Only the swimmer (i.e. the Client or his or her child registered for lessons) may enter the pool and may only do so during the lessons.

  2. The Client will be responsible for providing his or her own towels and/or towels for his or her child.

  3. The Client will throw away all diapers and garbage and keep pool areas and bathrooms clean.

  4. No eating or drinking on the pool deck.

  5. Hotel hot tubs, saunas, steam rooms, and water slides are not to be used before and/or after the lessons. These amenities are off limits to the Swim School and its clients.

  6. Clients will return hotel key cards to the front desk within 20 minutes of the end of the lessons.

  7. All non-potty-trained students must wear three layers over their bottoms to prevent accidents and leakage. Reusable swim diapers, disposable swim diapers, plastic coverings, and bathing suits are all acceptable layers. Where accidents leak into the water, the remainder of the lessons for that day must be cancelled.

  8. The Swim School will not be responsible for the cancellation of the lessons due to the closing of a pool for any reason whatsoever. The Swim School agrees to promptly inform the Client of any such cancellation and reschedule the lessons as soon as reasonably possible.

5. The Client agrees to abide by the following rules and accept the following terms and conditions concerning the Swim School’s “Parents and Tots” lessons:

  1. Once registered, the Client will be committing to the specific day and time of the week for the entire session.

  2. Full payment and acceptance of the terms and conditions of this Agreement and the Swim School’s liability waiver must occur before the first class of each session.

  3. Make-up lessons and/or refunds are not granted for Parents and Tot classes due to the number of occupants per lesson.

  4. Refunds will not be available once the session begins.

  5. There is a maximum 4 babies per lesson, with one parent in the water per baby at a time unless otherwise instructed.

  6. All non-potty-trained students must wear three layers over their bottoms to prevent accidents and leakage. Reusable swim diapers, disposable swim diapers, plastic coverings, and bathing suits are all acceptable layers. Where accidents leak into the water, the remainder of the lessons for that day must be cancelled.

6. The Client agrees to abide by the following rules and accept the following terms and conditions concerning the Swim School’s private swimming lessons:

  1. Once registered, the Client will be committing to the specific day and time of the week for the entire session.

  2. Full payment and acceptance of the terms and conditions of this Agreement and the Swim School’s liability waiver must occur before the first class of each session.

  3. Clients may reschedule, on 48 hours’ notice, one (1) lesson per session. Cancellations without sufficient notice or additional cancellations will result in forfeited lessons.

  4. All rescheduled lessons are to be scheduled directly with the Swim School administration team by email. The location, date, time and instructor for all rescheduled lessons shall be at the discretion of the Swim School and failing agreement between the Client and the Swim School with respect to the same, the rescheduled lesson shall be forfeited.

  5. In the event a Client cancels the remainder of a session after it begins, a refund will be provided for the number of lessons remaining in the session, subject to a five dollar ($5) per lesson cancellation fee.

  6. Late payments shall be subject to a five dollar ($5) per month late payment fee. Late payments that are ninety (90) days outstanding or more shall be sent to collections. In addition to the late payment fee referenced in this section, the Client shall be responsible for any and all costs incurred by the Swim School to secure amounts due and owing by the Client.

  7. A parent or guardian of at least one of the students must be at each lesson where students are minors. Swim School instructors reserve the right, in their sole discretion, to cancel a lesson where no guardian is present, and the Swim School will not provide refunds for such cancellations.

7. The Client agrees to abide by the following rules and accept the following terms and conditions concerning backyard lessons provided by the Swim School:

  1. Unless otherwise agreed by the parties, all lessons will be conducted in the Client’s in-ground, backyard pool. The Client’s pool must be well maintained, as determined by the Swim School or its instructors in their sole discretion, and kept at a temperature above 85 degrees Fahrenheit during lessons.

  2. Chemical levels and pool maintenance are the Client’s responsibility. Client’s will keep a record of the pool’s daily chemical checks and provide the same to the Swim School or its instructors upon request. If the pool’s chemical levels, heat, or maintenance are unacceptable for lessons, the Swim School or its instructors will, in their sole discretion, have the right to cancel backyard lessons, with no refunds or make-up classes provided.

  3. Clients may reschedule one (1) lesson per session. Same-day or additional cancellations will be considered a forfeited lesson.

  4. All rescheduled lessons are to be scheduled directly with the Swim School administration team by email.

  5. In the event a Client cancels the remainder of a session after it begins, a refund will be provided for the number of lessons remaining in the session, subject to a five dollar ($5) per lesson cancellation fee.

  6. Late payments shall be subject to a five dollar ($5) per month late payment fee. Late payments that are ninety (90) days outstanding or more shall be sent to collections. In addition to the late payment fee referenced in this section, the Client shall be responsible for any and all costs incurred by the Swim School to secure amounts due and owing by the Client.

  7. Thunder and/or lightning will also result in postponed lessons.

  8. A parent or guardian of at least one of the students must be at each lesson where students are minors. Swim School instructors reserve the right, in their sole discretion, to cancel a lesson where no guardian is present, and the Swim School will not provide refunds for such cancellations.

8. The Client agrees to allow photographs and/or videos to be taken of his or her child during the lessons, and consents to the use of such photos by the Swim School for promotional purposes, including on the Swim School’s website, Facebook page, and in social or print media. The Client may revoke the consent granted in this paragraph at any time by providing notice in writing to the Swim School.

9. The Client agrees not to participate in lessons or allow their child to participate in lessons while suffering from an infectious illness or condition. The Swim School’s instructors shall have the right to cancel a student’s participation in a lesson if, in his or her discretion, a Client or swimmer is not well enough to participate. Any such cancellations will result in forfeited lessons that may not be rescheduled in accordance with the terms of this Agreement. The Swim School shall not be held liable for any illness or condition passed to a Client or swimmer by any other individual. 

10. The Swim School has the right to terminate this Agreement at any time and refuse to provide further lessons should the Client and/or his or her child breach its terms and conditions or engage in conduct that is inappropriate. Such conduct may include, but is not limited to, refusing to obey instruction from Swim School staff, behaving in a disrespectful manner towards a member of staff, or another Client, student, or any other person, or causing damage to pool premises.

11. The Client, personally and on behalf of any minor child, hereby assumes all risk relating to the swimming lessons, whether foreseeable or unforeseeable, and releases the Swim School, and its owners, directors, employees, assigns, agents or volunteers of any and all liability for injury, loss, damage or expense sustained as a result of taking part in activities organized by or associated with the Swim School. The Client acknowledges, personally and on behalf of any minor child the existence of known risks, and potential unknown risks, which may include but are not limited to serious injury, including permanent disability and death, and social and economic loss. The Client agrees to waive any and all claims he or she may have in the future against the Swim School and/or its representatives and their respective servants, successors, assigns, agents, or employees, and agrees to release the Swim School and its representatives and their respective servants, successors, assigns, agents or employees from any and all claims, demands, damages, actions or causes of action arising out of or in consequence of any loss, injury, damages (including death) or expense that  may be suffered as a result of attendance at or participation in any and all activities organized by or associated with the Swim School, notwithstanding any such loss, injury, damages (including death) or expense having been caused by reason of the negligence of the Swim School, its representatives, servants, successors, assigns, agents or employees.

12. The Client agrees to hold harmless and indemnify the Swim School from any and all liability for any loss, damage, injury or expense to any third party, resulting from my attendance and participation in activities organized by or associated with the Swim School.

13. In situations where emergency medical services are required, such as an ambulance, the entire cost of the same will be borne by the Client.

14. This Agreement will be governed and interpreted in accordance with the laws of the Province of Saskatchewan, and the parties irrevocably attorn to the exclusive jurisdiction of the courts of Saskatchewan.

15.  If any provision of this Agreement is or becomes illegal, invalid or unenforceable, the illegality, invalidity or unenforceability of that provision will not affect the legality, validity or enforceability of the remaining provisions of this Agreement.

16. The rights and obligations contained in this Agreement shall enure to the benefit of and be binding upon the parties, their respective successors and permitted assigns
